1. Introduction
These Terms of Service (the "Terms") govern your access to and use of the websites, applications, and services (collectively, the "Services") made available by Moneytree, Inc., operating as AWASHDIRECT LLC ("Moneytree", "we", "us", or "our"). By creating an account or using the Services, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years of age and legally able to enter into a binding agreement to use the Services. The Services may not be available in all U.S. states or jurisdictions, and we may decline to open or maintain an account at our discretion.
3. Identity verification
You must complete identity verification (KYC) before your account is activated. You agree to provide accurate, current, and complete information, and to update such information when it changes. We may request additional information at any time to comply with applicable law.
4. Custodial wallet
Moneytree provides a custodial wallet for supported digital assets, including BTC, ETH, and USDT. We safeguard the private keys associated with your wallet on your behalf. You retain beneficial ownership of the digital assets credited to your account, subject to these Terms.
5. Transfers and limits
You may initiate transfers of supported digital assets from your account, subject to: (a) network conditions and applicable network fees; (b) transaction limits, which depend on your verification level; and (c) any restrictions required by law or our compliance program.
6. Fees
Network fees may apply on outgoing transfers. Where Moneytree charges service fees, those fees will be disclosed in the dashboard or other Services prior to confirmation of the relevant transaction.
7. Prohibited activity
You may not use the Services to: (a) violate any applicable law or regulation; (b) engage in fraud, money laundering, or terrorist financing; (c) circumvent any sanctions program; (d) infringe the rights of any third party; or (e) attempt to interfere with the integrity, security, or operation of the Services.
8. No investment advice
Moneytree does not provide investment advice, tax advice, or trading signals. Nothing in the Services should be construed as a recommendation to buy, sell, or hold any digital asset. You are solely responsible for your decisions.
9. Risk disclosures
Cryptocurrency involves risk. We do not guarantee profits or investment returns. Digital assets may lose value, and price changes can be sudden and significant. On-chain transfers are generally irreversible.
10. Suspension and termination
We may suspend or terminate your access to the Services, in whole or in part, if we reasonably believe that you have violated these Terms, applicable law, or our compliance policies, or if doing so is necessary to protect the integrity of the Services.
11. Changes to the Services and Terms
We may update the Services and these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of those changes.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly required by law.
13. Limitation of liability
To the maximum extent permitted by applicable law, Moneytree will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with the Services.
14. Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles, except where federal law applies.
